{"id":1398,"date":"2016-03-15T19:03:31","date_gmt":"2016-03-15T19:03:31","guid":{"rendered":"http:\/\/williamslawpanama.com\/?p=1398"},"modified":"2023-07-26T19:41:18","modified_gmt":"2023-07-27T00:41:18","slug":"permanent-residency-under-the-category-of-friendly-nations-visa-adopted-through-executive-decree-n-343-of-2012","status":"publish","type":"post","link":"https:\/\/williamslawpanama.com\/es\/permanent-residency-under-the-category-of-friendly-nations-visa-adopted-through-executive-decree-n-343-of-2012\/","title":{"rendered":"<!--:en-->Permanent Residency under the category of Friendly Nations Visa, adopted through Executive Decree N. 343 of 2012<!--:--><!--:es-->Residencia Permanente bajo La categor\u00eda de Pa\u00edses Amigos adoptada por el Decreto Ejecutivo Nro. 343 de 2012<!--:-->"},"content":{"rendered":"<p><!--:en-->The Republic of Panama with a vision of becoming one of the countries with better immigration incentives worldwide, created through Executive Decree N. 343 published on May 16, 2012, the subcategory that grants permanent residency for foreign citizens of \u201cSpecific Countries that Maintains Friendly, Professional, Economic and Investment Relations\u201d with the Republic of Panama, in which we can find the following countries as members:<\/p>\n<p>Andorra, Argentina, Australia, Austria, Belgium, Brazil, Canada, Chile, Costa Rica, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Ireland, Israel, Japan, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Marino, Montenegro, Netherlands, New Zealand, Norway, Paraguay, Poland, Portugal, Serbia, Singapore, Slovakia, Spain, South Africa, South Korea, Sweden, Switzerland, Taiwan , United States of America, Uruguay, United Kingdom and finally Mexico , the most recent country incorporated.<\/p>\n<p>The process before the National Immigration Service is relatively simple to obtain, hence this category offers the shortest process timeframe to obtain the permanent residency, also taking into consideration that this category grants to the applicant the right to obtain a Work Permit and the panamanian identification document (I.D.) in a period less than one (01) year, which represents one of many benefits and is very important to consider when someone is deciding to immigrate and relocate in a foreign country. It\u2019s important to note that any foreign can apply for the Panamanian Nationality, once he has been a permanent resident for a period longer than 5 years.<br \/>\nOn the other hand, the permanent residents under this category will be able to apply for bank loans to purchase properties or vehicles while obtaining excellent financial rates around 97%, therefore the bank will only require a down-payment equal to 3% value of the property, this will be possible once the foreigner obtains his Panamanian I.D. This is one of many benefits when immigrating under this category.<br \/>\nIn this sense, the documents required by the National Immigration Service in order to grant the permanent residency are the following:<\/p>\n<ol>\n<li>The applicant must justify his interest of investing in Panama to be eligible to apply for the Permanent Residence Visa, in accordance with the economic or professional activity, this requirement can be satisfy trough the incorporation of a Panamanian Company or a Private Interest Foundation, or through the purchase of a property in Panama or presenting a Labor Contract of a Company duly incorporated in Panama.<\/li>\n<li>Complete Passport Copy of the applicant, which must be valid for the next six (06) months and duly notarized before a Panamanian Public Notary.<\/li>\n<li>The applicant must open a bank account in Panama in which must maintain a minimum balance of US$ 5,000.00 and US$ 2,000.00 for each dependent in order to comply with the requirement of Economic Solvency, which can be demonstrated trough a Bank Reference or Bank Statement duly stamped by the bank in which is established such amounts in numbers or digits (Minimum 4 medium digits). It\u2019s important to note that the National Immigration Service considers Bank References and Bank Statements only valid for a period of one (01) month.<\/li>\n<li>Regarding the so addressed Certified Checks, it\u2019s necessary to issue two (02): The first one for the amount of US$250.00 in favor of National Treasury, which is used to cover the cost for the application under an immigration category; and the second, for the amount of US$800.00 in favor of the National Immigration Service, which is a deposit that can be used by such entity to cover the expenses for the repatriation purposes, this check can be recoverable once one (01) year has passed.<\/li>\n<li>Also, the National Immigration Service requires the Criminal Record of the applicant and his dependents, this document must be issue by the country in which the applicant has been a resident in the last two (02) years, must be duly Apostille, if the country is a member of the Haya Convention; or legalized before the Panamanian Consulate or Embassy in the country issuing the Criminal Record.<\/li>\n<li>Copy of personal I.D. or resident I.D. of your country, which will need to be duly authenticated before a Panamanian Public Notary.<\/li>\n<\/ol>\n<p>It\u00b4s important to note that if any document is legalized by the Panamanian Consulate or Embassy, this document will need to be verified and validated by the Ministry of Foreign Affairs, process that can take around four (4) working days.<\/p>\n<p>Dependents<\/p>\n<p>The applicant will be able to include in the same petition as dependent is spouse and children under 25 years of age, as long as they proof:<\/p>\n<ol>\n<li>The family relationship. In the case of the spouse, the marriage certificate, and the children with birth certificate duly Apostille or legalize.<\/li>\n<li>In the latter case, the applicant will need to proof that the children are dedicated completely to their education either in high school or university, and a single certificate issued from the country of origin will be necessary, this document must be Apostille or legalize.<\/li>\n<li>Additionally, the applicant shall render a letter of responsibility duly signed, establishing that he or she will be responsible financially for his dependents.<\/li>\n<\/ol>\n<p>Finally, the National Immigration Service will require from the applicant and dependents a health certificate issued by a Panamanian license doctor and personal affidavit form, which basically consist in filling a form issued by the National Immigration Service.<\/p>\n<p>The approximate time to obtain the Permanent Residence under this category is between four (4) to five (5) months. The working permit can take between two (2) to three (3) additional months.<\/p>\n<p>For any additional information do not hesitate in contacting us, since we are the leading firm in Permanent Residency, under Executive Decree 343 or, better known as Friendly Nations Visa.<\/p>\n<p>Remember to follow us on Facebook and Twitter:<\/p>\n<p>@willliamslawpanama<br \/>\n@williamspanama<!--:--><!--:es--><\/p>\n<p>La Republica de Panam\u00e1 con la visi\u00f3n de convertirse en un pa\u00eds con mejores incentivos en materia migratoria a nivel mundial, crea mediante Decreto Ejecutivo Nro. 343 de fecha 16 de mayo de 2012, la subcategor\u00eda que otorga la residencia permanente para aquellos extranjeros nacionales de \u201cPa\u00edses Espec\u00edficos que Mantienen Relaciones Amistosas, Profesionales, Econ\u00f3micas y de Inversi\u00f3n\u201d con la Republica de Panam\u00e1, en donde se pueden destacar los siguientes pa\u00edses miembros:<br \/>\nAndorra, Argentina, Australia, Austria, B\u00e9lgica, Brasil, Canad\u00e1, Chile, Costa Rica, Croacia, Chipre, Rep\u00fablica Checa, Dinamarca, Estonia, Finlandia, Francia, Alemania, Grecia, Hong Kong, Hungr\u00eda, Irlanda, Israel, Jap\u00f3n, Letonia, Liechtenstein, Lituania, Luxemburgo, Malta, M\u00f3naco, Marino, Montenegro, Pa\u00edses Bajos, Nueva Zelanda, Noruega, Paraguay, Polonia, Portugal, Serbia, Singapur, Eslovaquia, Espa\u00f1a, Sud\u00e1frica, Corea del Sur, Suecia, Suiza, Taiw\u00e1n, Estados Unidos de Am\u00e9rica, Uruguay, Reino Unido y finalmente M\u00e9xico, siendo el m\u00e1s reciente pa\u00eds incorporado.<\/p>\n<p>En primer lugar, los requisitos exigidos para iniciar este tr\u00e1mite ante el Servicio Nacional de Migraci\u00f3n son sencillos, lo que lo convierte en el proceso m\u00e1s r\u00e1pido para obtener una residencia permanente, sin dejar de lado que adem\u00e1s de este beneficio, aporta la posibilidad de obtener un permiso de trabajo indefinido y una c\u00e9dula de extranjero en Panam\u00e1, en un periodo menor a un (01) a\u00f1o, lo cual proporciona grandes ventajas al tomar la decisi\u00f3n de emigrar y reubicarse en un pa\u00eds. Asimismo, los extranjeros podr\u00e1n optar por la Nacionalidad Paname\u00f1a, una vez que hayan sido residentes permanentes por m\u00e1s de 5 a\u00f1os.<\/p>\n<p>Por otra parte, dentro de los grandes beneficios de llevar a cabo el tramite migratorio bajo dicha categor\u00eda, es que el extranjero una vez reciba su cedula de identidad podr\u00e1 optar por pr\u00e9stamos bancarios para la compra de inmuebles y veh\u00edculos, obteniendo incre\u00edbles porcentajes de financiamiento que ascienden hasta el 97%, pagando \u00fanicamente un 3% de inicial.<\/p>\n<p>Ahora bien, los requisitos exigidos por el Servicio Nacional de Migraci\u00f3n para el otorgamiento de residencia permanente, se basan fundamentalmente en:<\/p>\n<ol>\n<li>Documentaci\u00f3n que demuestra la finalidad de requerir la residencia permanente, el b\u00e1sicamente se subsana mediante la incorporaci\u00f3n de una Sociedad o Fundaci\u00f3n Paname\u00f1a, o mediante la compra de un inmueble o presentando un Contrato de Promesa de Trabajo en una compa\u00f1\u00eda Paname\u00f1a. <\/li>\n<li>La copia completa del Pasaporte del solicitante, el cual deber\u00e1 contar con un m\u00ednimo de 6 meses de vigencia, debidamente autenticado por un Notario P\u00fablico Paname\u00f1o.<\/li>\n<li>De igual modo, el aplicante deber\u00e1 contar con una Cuenta Bancaria en un banco Paname\u00f1o con al menos US$5,000.00 y US$ 2,000.00 adicionales por cada dependiente, a los fines de cumplir con el requisito de Solvencia Econ\u00f3mica, el cual es demostrable mediante una Referencia Bancaria o Estado de Cuenta debidamente sellado por el banco, el cual refleje dicha cantidad en n\u00fameros o cifras (M\u00ednimo 4 cifras medias). Es importante resaltar, que para el Servicio Nacional de Migraci\u00f3n la vigencia de las Referencias Bancarias y  de los Estados de Cuenta por un periodo m\u00e1ximo de un (01) mes.<\/li>\n<li>En lo que respecta a los tan discutidos Cheques Certificados, son dos (2): El primero por la cantidad de US$250.00 emitido a favor del Tesoro Nacional, el cual esta destinado a cubrir el costo de la categor\u00eda migratoria; y el segundo, por la cantidad de US$800.00 emitido a favor del Servicio Nacional de Migraci\u00f3n, el cual se genera con la finalidad cubrir cualquier gasto relacionado con la repatriaci\u00f3n del aplicante, el mencionado cheque podr\u00e1 ser recuperable una vez haya transcurrido un (01) a\u00f1o. <\/li>\n<li>Adem\u00e1s, el Servicio Nacional de Migraci\u00f3n solicita un Record Policivo o Certificado de Antecedentes Penales, que debe ser emitido por el pa\u00eds donde el aplicante residi\u00f3 en los \u00faltimos dos (02) a\u00f1os, el mismo deber\u00e1 estar debidamente Apostillado, en caso que el pa\u00eds sea suscriptor del Convenio de la Haya; o, en su defecto, el aplicante deber\u00e1 legalizar dicho documento por medio del Consulado o Embajada Paname\u00f1a en el Pa\u00eds que lo emite.<\/li>\n<li>Copia del documento de identidad o carne de residencia de su pa\u00eds, la cual deber\u00e1 ser debidamente autenticado ante Notario P\u00fablico Paname\u00f1o.<\/li>\n<\/ol>\n<p>Es importante destacar que en caso de que sea legalizado ante Consulado o Embajada, este documento debe igualmente pasar por el Ministerio de Relaciones Exteriores de Panam\u00e1 para su verificaci\u00f3n y validaci\u00f3n, dicho proceso puede demorar alrededor de cuatro (04) d\u00edas h\u00e1biles.<\/p>\n<p>DEPENDIENTES <\/p>\n<p>El aplicante podr\u00e1 incluir en la misma solicitud como dependientes a su C\u00f3nyuge e Hijos menores de 25 a\u00f1os, siempre y cuando demuestren:<\/p>\n<ol>\n<li>El v\u00ednculo de parentesco.
